ok I have found some issue in the kubelet log:
I do not think that I have changed anything in the requests or limits but I can take a look into that... |

the pod definition does not contain any limit:
But there is some limitrange
Remove that fixed it...

My test cluster is a it strange I can use kubectl to access the api, the staticpods are ready but talosctl health report that the api server is not ready. talosctl upgrade-k8s is also stuck because the kube api server is not ready....
